TERMS AND CONDITIONS (“TERMS”)

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://www.dapetra.com/ website (the “Service”) operated by Da Petra d.o.o. “us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

LEGAL NOTICE

The company Da Petra d.o.o. will, by proper webpage design, try to ensure that the data on this web page is punctual and up to date, but DOES NOT take any responsibility for the punctuality of these data. All users use this data at their own risk. Da Petra d.o.o. or any other legal person or a private individual, who participated at the developing and designing of this page, are not liable for possible damages, which could stem from using information on this page or any mistakes and defectiveness in its content.

All information and pictures on the Da Petra d.o.o. webpages are, according to law, subject to the author’s protection or some other protection of intellectual property. Documents from these web pages may only be reproduced for non-commercial purposes, and must preserve all warnings about the author’s or other rights and cannot be copied, duplicated, or in any way distributed for commercial use.

Da Petra d.o.o. reserves the right to change the contents of these pages at any time, in any way, without a special reason and without previous notice. PRIVACY PROTECTION

Da Petra d.o.o. protects all visitors’ data according to the Personal Data Protection Law and other Slovene and European legislation. By sending his/her personal data using the request form, the visitor agrees that his/her data will be used by Da Petra d.o.o. for its internal statistical and data processing use. The company binds itself not to share personal data to other private individuals or legal persons for commercial uses.

Our web pages offer two ways of making an enquiry for our services.

One option is by e-mail: you send the enquiry by e-mail. You can also make an enquiry by using the request form. In both cases, we will send you our offer by e-mail. However, a mere enquiry or an offer does not count as a confirmed reservation – your confirmation of the offer is essential for the validity of a reservation. If we do not receive your confirmation, we cannot confirm the reservation of our services.

CANCELLING AN ORDER

A user of our services has the right to cancel a reservation. If the user cancels the arrangement, Da Petra d.o.o. has the right to refund costs. The total amount of the costs for the cancelled arrangement depends on the time when the user cancelled the arrangement.

Da Petra d.o.o. has the right to the following % from the arrangement price in cases of cancelling:

After payment of deposit – 30% of the arrangement price;

30 days before the event – 100% of the arrangement price.

The arrangement / package can be modified in agreement between Da Petra d.o.o. and the user. In cases of changing the arrangement on your own wish or for reasons of force majeure, without reasons on the side of Da Petra d.o.o., the user does not have the right to demand any claim or lowering of the price. The cancellation must be sent as a written document or by e-mail to the address petra@dapetra.com or Da Petra d.o.o., Tržaška 128, 1000 Ljubljana, Slovenia.

DATA USE

Da Petra d.o.o. protects all clients’ data according to the Personal Data Protection Law. It counts that the client, by accepting the offer, agrees with using his/her data for our statistical purposes and informing our clients of our offers. If the client does not wish to share his/her data for the above stated purposes, he/she can state that when contacting us.

LOG DATA

We may also collect information that your browser sends whenever you visit our Service (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics.

FINAL DETERMINATIONS

VAT is included in all prices of the Da Petra d.o.o. offer. Court of jurisdiction in Ljubljana is competent for all kinds of disputes between clients.

SERVICE PROVIDERS

We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used.

These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

INTERNATIONAL TRANSFER

Your information, including Personal Information, may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

If you are located outside United States of America and choose to provide information to us, please note that we transfer the information, including Personal Information, to United States of America and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

COOKIE REGULATIONS

In order to optimize the webpage in terms of system performance, practicability and provision of useful information about the services, Da Petra d.o.o. automatically collects and stores information in log files on the user’s computer. These include the user’s Internet Protocol (IP) address, data on the browser type and language settings, the operating system, Internet Service Provider (ISP), and date/time of the visit.

Da Petra d.o.o. uses this data to effectively manage the webpages in order to find out more about the behaviour of customers across the web pages, to analyse trends, and to collect comprehensive demographic information about the users. The collected data can be used for marketing and advertising purposes, as well as for communication (e.g. the optimisation and enhancement of the user experience to guarantee more attractive offers and services).

In the event of the usage of data which is not personal data, together with personal information, such data is treated as personal data as long as it is used collectively.

Also for the information gathered from cookies and other comparable techniques the Declaration on the Protection of Personal data from these Terms and Conditions applies.

WHAT IS A »COOKIE«?

Webpages, e-mails, web services, advertising and interactive applications can use so-called cookies (hereinafter: “cookies”) for the optimisation of services.

A cookie is a small file usually containing a sequence of letters and numbers that is loaded into the user’s terminal equipment (computer, mobile device, etc.; in these Terms and Conditions generally referred to as: “computer”) when visiting the Da Petra d.o.o. websites (Da Petra d.o.o. sends the cookie file to the user’s computer hard drive). For example, the Da Petra d.o.o. website can then use them to identify the user’s devices when the connection between the web server and the web browser is established. TRACKING AND ANALYSIS

For the continuous optimisation of its marketing communications, Da Petra d.o.o. uses the analytical software Google Analytics by Google Inc. on its webpages, which uses cookies for the purpose of analysing traffic (counting visitors, identification of browsers and keywords in search strings, problems with the navigation Panel). The webpages of Da Petra d.o.o. inform the user about the cookies and obtain their consent before using them or downloading them to the user’s device (computer).

This allows for online behaviour tracking; in the collection stage, the cookies store information on how users use the webpage, including the number of displayed pages, where the user comes from (geolocation), time of the visit and the number of visits, in order to enhance the webpage and ensure a quality user experience. This data is collected through tracking cookies. Data obtained through cookies is anonymous and is not associated with personal information. Da Petra d.o.o. does not share this information with any third party for their own use. If the user does not accept cookies, no information is stored.

Da Petra d.o.o. uses the following cookies for this purpose: their own session cookies and cookies for counting the number of visitors; cookies are only stored for as long as necessary in order to achieve their purpose or for the duration of the browsing session at the longest, and are deleted at the end of the session. 

ENABLING AND DISABLING COOKIES AND SIMILAR TECHNOLOGIES

Da Petra d.o.o. users can accept or reject all cookies on all visited web pages, whereas it shall be taken into consideration that most browsers automatically accept cookies; or block the usage of cookies by changing the settings in their web browser. For example, in Internet Explorer 8.0, the following needs to be carried out: 1. Select “Tools” and then “Internet Options”. 2. Click on the “Privacy” tab. 3. Use the slider to select the desired setting. In other internet browsers, follow the instructions of the browser in question to change the settings of the browser or delete cookies.

If cookies are disabled, some functions and complete functionality of the webpage are no longer available or do not operate properly.
